assumed duty of care

In general, English law does not regard an omission to
act (see: Omission) as conferring criminal liability.
One of the places where it might do so is where a duty of
care exists. Failing to act in
a way compatible with that duty of care may constitute
the actus reus of a criminal offence
(see: RVStoneAndDobinson1977.
