Co-parceny
Last modified: Thu Feb 23 16:37:37 2006
An obsolete form of CoOwnershipOfLand which was automatically assumed when
land was inherited by two or more sisters, there being no male heir. Each
co-parcenor held an equal share of the title, and had the same rights of
possession over the whole estate (we would call this an UndividedShare these days).
Unlike a TenancyInCommon, which it resembles
in other ways, a co-parecency could be severed at law, that is, it could be `partitioned'
into equal and distinct legal estates. A tenancy in common could not, and indeed still can not,
be partitioned without re-conveying the legal estate on different terms.
