[2004] UKHL 43. Legislative provisions that reverse the BurdenOfProof onto the defendant in a criminal action are not automatically incompatible with Art. 6(2) of the ECHR. Regard must be had to the proportionality of the statutory measure and the magnitude of the penalty it imposes. See ReverseBurdenOfProof for discussion.
