Limitation Act (1980)
Last modified: Thu Feb 23 16:37:37 2006
Sets out the maximum times which for which a claim for damages
will be heard. The main provisions are:
-
for a simple contract (see: SimpleContract), or a claim
concerning PersonalProperty, no more than 6 years
may elapse from the time at which action could first have be taken;
-
for a contract by deed (see: ContractByDeed), or a claim
concerning RealProperty no more than 12 years
may elapse from the time at which action could first have be taken;
-
if the claimant is unable to take action at the time at which it became
possible, perhaps as a result of disability, then these time periods are
to run from the point at which the claimant became capable.
-
such disability is only relevant if it is coincident with the point at
which action could first be taken; disability during the 6-year or 12-year
term does not extend the limitation.
