R v McGovern (1990)
Last modified: Thu Feb 23 16:37:37 2006
(1990) 92 Cr App R 228 (CA). The CourtOfAppeal held that the trial judge
should have excluded the defendant's confession on the grounds that
it was rendered unreliable by her circumstances. The defendant was
pregant and, when she was interviewed by the police, she was vomiting and
in distress. Compare RVGoldberg1988, where a confession elicited from
a herion addict in withdrawal was held to be admissible.
