R v Neddrick (1986)

In this case ([1985] 1 WLR 1025)
the Court of Appeal accepted the
House of Lords ruling in RVMoloney1985, and allowed that
forsight of the consequences of an action only evidences Intention
if the consequences are ``virtually certain'' (Lane LCJ).
Previously the Court of Appeal had tended to favour the ruling
in HyamVDPP1974, which had a far broader interpretation
of intention.
This is important because the facts of the Neddrick are
quite similar to Hyam. Neddrick set fire to a house by
pouring parafin through the letter box and setting it alight.
A small child died in the fire. The trial judge directed
the jury as in Hyam and a conviction for murder
was entered. The Court of Appeal, following R v Moloney
changed this to manslaughter.
