Torts (Interference with Goods) Act (1977)

Last modified: Thu Feb 23 16:37:38 2006

This Act sets out the process by which claims involving chains of title to goods are to be resolved, and attempts to limit the string of litigation that can arise in such cases. It stipulates that a person bringing an action for recovery of goods must identify any other persons who may have a superior title. These others are then given a chance to attend court to settle who has the best overall title. It also sets out steps to be taken to compensate a person who has been the subject of multiple claims in respect of the same property.

The Act also abolishes the tort of detinue, and expands conversion to encompass the small number of circumstances in which detinue might have been pleaded.
